  Priest Shouldn't Be on Sex Offender List, Lawyer Says

(February 8, 2007) — A lawyer for Rev. Michael Volino, who admitted to possessing child pornography, argued in court today that the Catholic priest should not be on the state sex offender registry when freed from prison next month.

Lawyer Michael DiPrima maintained in court arguments that a discrepancy between state and federal child pornography statutes should preclude Volino from being required to register as a sex offender in New York.

The federal statutes design child pornography as images of youth under 18, while state statutes set a younger age.

Assistant Attorney General Emil Bove responded that the state legislature clearly intended for people convicted of federal child pornography to also be eligible for the state sex offender registry.

Volino, 42, pleaded guilty to possessing child pornography. He is scheduled to be released from federal prison March 2.

State Supreme Court Justice Harold Galloway reserved his decision after arguments today.
