Prosecutor Won't Pursue Case against Ex-Minister's Wife

Columbus — Federal child pornography charges against a former Newark minister's wife were dismissed Wednesday.

In U.S. District Court, Judge George C. Smith dismissed the case against Judy Waser, 54, of Newark.

Assistant U.S. Attorney Deborah Solove filed a motion Tuesday to dismiss the one felony count of attempted possession of child pornography Judy Waser faced.

"I can't really say why it was dismissed," Solove said. "We don't plan to go forward with it."

Her husband, David Waser, 57, a former minister at Newark's Second Church of Christ, is being detained after pleading guilty last week in federal court to receiving child pornography.

As part of a plea agreement, David Waser pleaded guilty in U.S. District Court to one of his two felony charges and agreed to forfeit 11 videotapes and his computer.

He faces five to 20 years in prison.

The couple were arrested in August after David Waser's purchase of 11 videotapes that featured scenes of children, some as young as 4, involved in various sex acts with other children and adults. The videos were discovered by an undercover postal worker.

Judy Waser reportedly only knew about one child pornography video, and the postal inspector, Martin Arthur, told investigators Aug. 9 she was curious about seeing the tape.

In a written admission disclosed the same day in U.S. District Court, David Waser admitted to exposing himself and touching young girls during the past 37 years.

David Waser became the minister at the Second Church of Christ in 2001. He was the pastor there at the time of his arrest.

He is awaiting sentencing.
