  Former Priest Moved from State Prison Pending New Trial

Shepherdsville, Ky. — A former Roman Catholic priest whose conviction on sexual abuse charges was overturned by the Kentucky Supreme Court was transferred from state prison to a county jail on Thursday and could soon be free on bond.

Daniel Clark, 59, was moved to Bullitt County Jail a month after the Kentucky Supreme Court overturned his 2003 convictions on first-degree sexual abuse for molesting two boys between 1999 and 2002.

David Lambertus, Clark's attorney, argued that the Bullitt County jury that convicted Clark was not instructed properly by the trial judge. Lambertus said the trial judge also erred by allowing prosecutors to introduce evidence that Clark pleaded guilty in 1988 to sexual abuse and sodomy. The court overturned the conviction based on those two arguments.

Bullitt County Commonwealth's Attorney Mike Mann said Clark may be allowed to post bond before a pre-trial hearing scheduled for Aug. 8.

Mann added the state is unsure whether to retry Clark, who was sentenced to two five-year sentences. Clark has already served four years and would be eligible for early release relatively soon if he has behaved well behind bars.

Clark is the only former priest who has had a case heard before the state Supreme Court following the sexual-abuse scandal in the Archdiocese of Louisville. Four priests and two lay teachers within the Archdiocese have been convicted of abuse since 2002.

Clark was removed from the priesthood in 2004 after his sex abuse conviction.
