Chicago (IL) — A Wisconsin district attorney wants a Chicago Catholic priest convicted last year of sexual abuse to be sent immediately to prison because of a new molestation complaint.

A hearing has been set for next month in Walworth County, Wis., to consider the status of the Rev. Donald McGuire. He remains free pending appeal of his conviction for molesting two students in the 1960s.

McGuire, 77, was sentenced to seven years in prison and 20 years of probation. He recently moved from Wisconsin to southwest suburban Oak Lawn, though he has twice been jailed for violating probation.

"He was allowed to be out partially because these were old cases," said Walworth County District Attorney Phillip Koss, who has filed a motion to end McGuire's freedom.

Koss said authorities might never have allowed McGuire to cross state lines or remain free had they been notified by his religious order, the Chicago Province of the Society of Jesus, known as the Jesuits.

The Jesuits acknowledge that a college student told them in January that the priest had molested him over a three-year period, beginning in 1999 when the alleged victim was 13 years old.

The Jesuits' lawyer, Tim Toomey, said Wisconsin authorities weren't told because the allegations "didn't involve their jurisdiction."

"That's irresponsible," said Marc Pearman, an attorney who filed a lawsuit Tuesday in Cook County against the order and priest on behalf of the new complainant, now 21.

Toomey said he notified the Cook County state's attorney's office as early as February, but officials said they were only notified this week.
