  Zimbabwe: Accept or Deny Adultery Charge, Pius Told

Harare — The head of the Roman Catholic Church in Bulawayo, Archbishop Pius Ncube, has been told by Mr Onesimus Sibanda to either deny or accept the charge of adultery that he is facing and stop resorting to delaying tactics.

Mr Sibanda said this in response to a court application filed by the cleric last week, seeking an order to compel him to furnish the archbishop with specific details of the adultery allegations levelled against him. Mr Sibanda filed a notice of opposition and deposed an opposing affidavit at the High Court in Bulawayo on Monday through his lawyer, Mr Munyaradzi Nzarayapenga of Dube-Banda, Nzarayapenga and Partners.

In the affidavit, Mr Sibanda stated that he had read and understood what the archbishop wants but he was not happy with the language used to make the request.He also stated that there was nothing "vague and embarrassing" in his claim as alleged by Archbishop Ncube in his court application, and that it was a "fact" that he "suffered as a result of the adultery" that the cleric allegedly committed.

"I have read and understood the founding affidavit of Archbishop Pius Ncube and I wish to bring to this Honourable Court's attention my displeasure at the language used in the application, which I believe is not proper in court papers, with particular reference to paragraphs 10 and 14 that I am stubborn because I refused to supply particulars which are essential evidence. Mr Sibanda added: "What has been supplied surely can enable Applicant to understand that I am saying he committed an act of adultery with my wife knowing that she was married to me, he should then state whether he did it or not, not to insist that I supply him will all my evidence."

He further stated that the issue of "how" he arrived at the $20 billion quantum of damages was clearly part of evidence and was again "not necessary" at this stage of the case.

"Apart from that, I am not stubborn and have given good reasons clearly to supply those particulars. I am more than convinced at this stage that the Archbishop is definitely aware of the case against him, which is basically that from January 2006, he had an illicit and adulterous sexual relationship with Rosemary Sibanda, who is my lawful wife, knowing that she is my wife."
