ELKHORN - He was convicted of molesting boys and yet Father Donald McGuire is a free man.

A jury convicted McGuire more than a year ago of molesting two young boys in Fontana. The victims alleged it happened nearly 40 years ago.

But Judge James Carlson ruled Thursday, the renowned priest was not a threat and could continue to live in Chicago while he appeals his conviction.

"I'm disappointed. The streets are still not safe," said one of his alleged victims. He wanted to hide his identity.

"It's not fair to society. It's not fair to the kids. We have to protect them and right now we don't have anyone capable of doing that," he said.

Although Judge Carlson does not believe McGuire is a threat, there are new allegations McGuire may have molested another boy as recent as 2003.

McGuire and his attorney would not comment after court, but his supporters say he's innocent.

"I know him. I know he's a decent man who would not do those things," John Gahagan said.

For now McGuire returns to Chicago, where he is staying at a private residence. He will be back in court for a hearing on his appeal in November.

And his alleged victim isn't happy.

"He was found guilty, he is guilty, we all know it," he said.
