  Diocese to Seek Dismissal of Its Bankruptcy Case

SAN DIEGO: The Roman Catholic Diocese of San Diego will go to court Oct. 25 to ask that its bankruptcy case be dismissed after reaching a $198 million settlement last month with 144 childhood sexual abuse victims.

Diocese attorneys filed a motion to dismiss the case Monday, more than six months after seeking bankruptcy protection against dozens of civil lawsuits.

The settlement calls for $198,125,000 to be paid in two lump sums next year by the diocese, Catholic Mutual insurance and the San Bernardino diocese, which was part of San Diego's jurisdiction until 1978.

The allegations against priests and other Catholic personnel date back decades and involve men and women who say they were molested when they were minors. The claims are part of hundreds of lawsuits filed across California during 2003, after the state suspended the usual time limit on these kinds of civil cases for one year.
