  McGuire Motions under Way

The post-conviction motion hearing for The Rev. Donald McGuire, a renowned Jesuit priest convicted of nearly 40-year-old child molestation charges, is underway at the Walworth County Judicial Center.

McGuire's attorneys are arguing there is new evidence to support a re-trial and also accuse former defense counsel Gerald Boyle of being ineffective.

Attorney Robert R. Henak is trying to show Boyle failed to call witnesses who could have shown McGuire's two accusers were lying because they knew each other long before the criminal trial started in 2005. The accusers testified they had really known each other until their accusations became known to one another.

Boyle defended his work on the case, saying that putting the accusers together earlier may have corroborated their claims.

"I think I made it clear that I was not interested in any such testimony from anyone if it would be counterproductive," Boyle said. "I was absolutely certain it would be counterproductive. I thought I explained it to Father McGuire. Obviously I hadn't explained it well enough."
