  Controversy over Wi Supreme Court Justice in Church Abuse Case

A Wisconsin Supreme Court Justice will hear a case that could free a retired priest from prison, a priest that years ago, he chose not to prosecute for sexual assault against children.

Back in 1979, Supreme Court Justice Daniel Prosser decided he didn't want to go after Fr. John Patrick Feeney because it would cause harm to Todd and Troy Merryfield, a pair of boys whom Prosser abused.

They were 12 and 14 years old and living in Freedom, WI at the time.

After Feeney left the state documents from the group SNAP say he abused other boys and later received sexual favors with jail inmates.

He was brought back on extradition for abusing the Merryfields and sentenced to 15 years in prison.

Now, a case before Prosser and the Supreme Court involving another priest could get Feeney freed.

Troy tells the Journal Sentinel that Prosser shouldn't hear this case.

Prosser is not Catholic. A spokesman for Prosser said that since litigation was pending before his court, he couldn't comment.
