  Prosser Steps Aside in Priest Case

When the Wisconsin Supreme Court met today to hear oral arguments in an case involving a priest accused of sexual misconduct, one justice was missing: David Prosser.

SNAP, an outspoken group of survivors of abuse by priests, had earlier called on Prosser to step aside. Nearly 30 years ago Prosser was the district attorney in Outagamie County. Two young brothers had been abused by a priest -- John Patrick Feeney -- and Prosser reviewed the polce investigation. Accompanied by a church official, Prosser went to the victims' home and urged their mother not to pursue the matter. He argued that a trial would would be too stressful for the children.

Feeney, 81, went on to abuse ohter children and is now serving a prison sentence in Wisconsin.

Peter Isely, a spokesman for the survivors, noted that the case argued before the court today could result in Feeney going free. The case heard today today involves Bruce McArthur. Like Feeney, he was charged criminally because he had left the state before the statute of limitations had expired. McArthur is arguing that the court should not allow the statute of limitations to stop tolling while he was out of state. If he is successful, Feeney could also be freed.

Tom Sheehan, a spokesman for the high court, said Prosser recused himself in the case but would not comment further.
