  Evaluation Ordered for Ex-Teacher in Child Sex-Abuse Case

ST. GEORGE - A 34-year-old Washington City man scheduled for sentencing Tuesday on two counts of third-degree felony attempted sexual abuse of a child was ordered to undergo a diagnostic evaluation instead.

Gabriel E. Carlin appeared before 5th District Judge Eric Ludlow, who ordered Carlin to turn himself in at the Washington County jail Friday by 6 p.m. to be taken into custody by the Department of Corrections, which will perform the evaluation.

Carlin, a former teacher, pastor and day-care operator, was originally charged with four counts of first-degree felony aggravated child sex abuse for kissing and fondling an 11-year-old girl in March 2006. At the time, Carlin owned the now-defunct East Harbor Christian Academy in Washington City where the victim was a student.

Heidi Nestel, an attorney with the Utah Crime Victims Legal Clinic representing the victim in the case, asked Ludlow on Tuesday to have Carlin taken into custody immediately.

She claimed Carlin was a flight risk and that his freedom on $100,000 bond is causing mental distress to the family, who wants to see him in prison.

Ludlow was not swayed, but warned Carlin to report to the jail Friday or face an automatic prison term.

Carlin's sentencing hearing was reset for Jan. 27.
