  Troy Man Indicted in 1986, 1989 Child Sex Assault Cases

A 60-year-old Troy man has been indicted by a Berkshire County grand jury on charges of sexually assaulting a child in connection with incidents alleged to have occurred in 1986 and in 1989.

Gary Mercure, who was a priest at the time of the incidents, has been charged with two counts of raping a child with force and one count of indecent assault and battery on a child under 14 in connection with incidents alleged to have occurred in Great Barrington, Mass. or Monterey, Mass. between Sept. 1, 1986 and Dec. 31, 1986, said Berkshire County District Attorney Frederick Lantz.

The alleged victim in the case, a male, is now 33 years old.

Mercure has also been charged with one count of raping a child with force in connection with another incident alleged to have occurred in New Ashford between Feb. 1, 1989 and Feb. 28, 1989. The alleged victim in that case, also a male. is now 32 years old.

A Reverend Gary Mercure was suspended from the Albany Roman Catholic Diocese in January of 2008 after being accused of sexually boys in the mid-1980s. The diocese decided to defrock the priest after conducting its own investigation.

Ken Goldfarb, spokesperson for the Albany Diocese, told CBS 6 he believed this was the same Gary Mercure, but could not say for sure.

Lantz said he did not know whether Mercure was a priest with the Albany Roman Catholic Diocese.

Mercure is scheduled to be arraigned in Berkshire Superior Court on Nov. 18 at 2 p.m.
