Fresno, CA (KFSN) — A judge ordered a new trial against the catholic diocese in Fresno after the discovery of new evidence.

Attorneys for brothers George and Howard Santillan presented new evidence last week saying they can prove the local bishop covered up their sex abuse at Saint John's Parish in Wasco.

Monday morning, the Fresno County Judge ordered the new trial but it will only cover one of the brothers, Howard Santillan.

Earlier this year a jury gave the brothers a partial victory and found that Monsignor Anthony Herdegen sexually abused them more than thirty years ago. But jurors did not believe the Fresno Catholic Diocese knew about the molestation.

A date has not yet been set for the new trial.
