The insurance company named in a lawsuit against the Catholic Diocese of Green Bay in a sexual abuse case was dismissed from liability in a ruling issued this week by Outagamie County Judge Nancy Krueger.

The decision came in the case of Todd and Troy Merryfield, brothers who were abused by former priest John Feeney in 1978 when the two were 12 and 14 years old.

Feeney was then the parish priest at St. Nicholas Catholic Church in Freedom.

Feeney was later convicted of sexual abuse charges and is serving a 15-year prison sentence.

The insurance carrier, Indiana Insurance Company, had argued their liability coverage did not extend to the activities alleged in the lawsuit such as "intentional acts."
