  Priest's Lawsuit over Family's Sexual Abuse Claims Dismissed

A Montgomery County judge dismissed a lawsuit last week brought by a suspended Roman Catholic priest against a family that accused him of sexually abusing their three children.

The Rev. John W. Broderick, 48, had been seeking $500,000, alleging the family made several "defamatory statements" about him. The suit was filed in November 2008.

Judge Felix J. Catena ruled Jan. 4 that the priest's lawsuit was "defective" because it was vague in mentioning specifics, according to court records. The suit, which names the alleged young victims, described several statements made by members of the family but didn't specify when or where they were made.

He was involved with the Dominican Sisters, a Catholic group not recognized by the Vatican that runs the Holy Name of Jesus Academy in Massena. He worked there from mid-2007 until his arrest in February 2008 at the school.

No complaints were filed against him in Massena.

The same judge in April dismissed criminal charges against the priest because a jury should not have been asked to consider a lesser charge. He had been accused of having inappropriate sexual contact with three children, ranging in age from 5 to 11, in early 2007.

A jury in February found him guilty on a misdemeanor child endangerment charge, but acquitted him of felony sexual abuse.
