  Jersey Man Indicted in Rockland on Charge That He Videotaped Child Sex Abuse

NEW YORK -- A Rockland County grand jury has indicted a Dumont, New Jersey man on eight counts charging him with sexually abusing an 11-year-old girl while she slept, and in one instance, videotaping it.

On December 13, 2009, Alex Avila, 35, allegedly improperly touched the victim while she was sleeping and videotaped it during one of two encounters.

A member of the Mission Assembly of God Church in South Nyack discovered the images on January 14 while viewing the photos in the digital camera loaned to her by Avila's wife. The congregant turned over the video to the church pastor, who contacted the child's parents and police.

Avila confessed to sexually abusing the girl to the pastor and later admitted recording the second incident while being interviewed by Clarkstown Police detectives.

Avila has been indicted on two counts of sexual abuse in the first degree, one count of use of a child in a sexual performance, one count of promoting an obscene performance by a child and one count of possession an obscene sexual performance by a child, all felonies, and three counts of misdemeanor endangering the welfare of a child.

He faces up to 15 years in state prison if convicted.
