  Boy Told Teacher Not to Touch Him, Court Hears

AS Richard McPhillamy allegedly squeezed the boy's naked buttocks while he dried off in the shower, the St Stanislaus' College student made it clear that he did not approve.

"F--- off you dirty f---ing perve, leave me alone," the boy shouted at the assistant house master of the Bathurst school.

A week later, the student was hauled to the headmaster's office and told that swearing at staff members "wasn't tolerated" at the Catholic boys' college, before he was sent away to be given the cane.

It was not the first occasion Mr McPhillamy had allegedly touched the boy. In a separate incident earlier that year he had allegedly indecently assaulted the student while cuddling him in the staff member's private quarters, the District Court in Sydney heard yesterday.

Mr McPhillamy, 49, has pleaded not guilty to five counts of indecent assault and one of sexual assault of two boarders during the mid-1980s, while he was working at the college.

During his opening remarks to the jury, the Crown prosecutor, Jose Crespo, said the first complainant, now in his mid-30s, had intended to tell the then headmaster, Peter Dwyer, why he had sworn at Mr McPhillamy. But he was not given the opportunity.

The second student, an "extremely homesick" 13-year-old was very upset and did not want to return to school following a weekend with his parents.

"The accused, Mr McPhillamy, was around and pointed him to his private room and he suggested to the complainant that he could make him feel better by giving him a massage," Mr Crespo said.

After massaging him on the neck and shoulders Mr McPhillamy allegedly worked his hands down the boy's back and buttocks but "it didn't stop there", he said.

The court heard that the boy's father had attended the school decades earlier. Mr Crespo said he'd sent his son there believing it would provide "a safe place for young men and a sound education".

As the year progressed the behaviour of both boys at school began to deteriorate and they were disciplined for it. The court heard that photos of both alleged victims were found in Mr McPhillamy's home during a police search in December 2008.

Four images of child pornography were also found on his computer. The trial continues.
