Andrew Nicastro is suing retired Springfield Bishop Joseph Maguire and disgraced former Bishop Thomas Dupre because they supervised de-frocked priest Alfred Graves, who allegedly abused him.

This past April, Dupre spoke with Nicastro's attorney John Stobierski in Washington D.C. about this alleged abuse.

During the deposition, Stobierski said Dupre repeatedly avoided the questions by 'pleading the fifth'.

Wednesday, Dupre's attorney, Michael Jennings, filed to impound the videotaped interview...hiding it from the media and the public.

Outside of the courtroom, Nicastro's attorney told 22News that it's important that the video is released, not just the written statement.

"Any time you see a witness on the witness stand, you look at one's demeanor. And demeanor does not come across on a written page. It does come across on a video tape,” said Stobierski.

Attorney Jennings told the judge releasing the video would embarrass Dupre, and could lead to harassment ... or worse.

"I feel we went through much worse,” said Alleged Clergy Abuse Victim Andrew Nicastro.

Nicastro told 22News the fact that the Bishop wants to keep the tape secret speaks for itself.

"But if there was no wrongdoing, and there was no problems, then I'd think he wouldn't have a problem with any of the answers coming out. If indeed he really was a negligent supervisor of my abuser than he needs to answer for it,” said Nicastro.

Judge Bertha Josephson is expected to make a decision tomorrow morning.

Thomas Dupre is the nation's first bishop ever to be indicted.
