PITTSFIELD, Mass. - A trial date has been set for a former priest from Troy, charged with sexual assault in Pittsfield.
Gary Mercure's trial is set for Jan. 31. He is accused of raping two boys, one in 1986 and the other in 1989.
The alleged victims were 11 and 13 years old at the time.
Mercure's lawyer says his client voluntarily gave a sample of his DNA. He says it doesn't match DNA found on clothing worn by one of the victims.
In 2008 the Roman Catholic Diocese of Albany removed Mercure from the priesthood after four other men accused him of sexual abuse.
