  Warren County DA Testifies in Priest Sexual Abuse Trial

The trial of a former Priest from Queensbury continued Monday. Gary Mercure is charged with raping two altar boys from Our Lady of Annunciation Church in Queensbury,while on outings in the Berkshires. Both victims are in their mid-thirties now and testified against Mercure.

On the stand Monday, Was Warren County DA Kate Hogan. Hogan was questioned about her investigation of the alleged victims' claims and the statute of limitations in New York State which expired, preventing prosecution here.

Mercure's attorney pressed Hogan about her notes when speaking to the alleged victims questioned why she did not write anything down that indicated claims of abuse in Massachusetts.

Also on the stand Monday, a forensic scientist from the New York State Police Crime Lab. He testified that on the undergarments tested, neither the victims nor Mercure's DNA was present, but the victim's father's DNA was. He also testified that the evidence was not properly stored and therefore complete profiles could not be made.

The trial will resume Wednesday. One more witness will be called and the case is expected to go to the jury in the afternoon.
