A sexual abuse victim defends state Supreme Court Justice David Prosser in a new television ad, blasting Assistant Attorney General JoAnne Kloppenburg and her supporters for another ad that highlighted Prosser's 1978 decision not to prosecute the priest who abused the man.

Kloppenburg is challenging Prosser in Tuesday's election for a 10-year term on the high court.

In an earlier ad, the liberal Greater Wisconsin Committee questioned Prosser's role in the case against Father John Patrick Feeney, who was later convicted of abusing Troy Merryfield and attempting to abuse Merryfield's brother when they were children. Prosser, who was Outagamie County district attorney at the time, has said the most damaging evidence didn't come out until after he left office.

Merryfield, who now lives in Virginia, and Prosser have previously denounced the Greater Wisconsin Committee ad and asked that it be taken down. The group has refused to stop running the ad. Kloppenburg has declined to ask it to do so, saying it's a matter of freedom of speech.

In the new ad, sponsored by the little-known conservative group Citizens for a Strong America, Merryfield says Prosser helped bring Feeney to justice. He says he and his brother are "being victimized again. This time, JoAnne Kloppenburg's allies want to use our pain for their own gain."

As recently as three years ago, Merryfield was critical of Prosser, saying the justice should recuse himself in sexual abuse cases. Merryfield has declined to explain his change of heart.
