  Update: William Casey Trial Delayed in Sullivan County

Casey's accuser Warren Tucker called the judicial delay frustrating.

"It's part of the reason why people don't come forward, that people don't put their families through this," Tucker said. "Basically, you have to quit your job, abandon your family, and do this for years."

The new evidence that sparked the delay includes two tapes from McDowell County, NC. Casey pleaded guilty to crimes against nature there last year.

According to Sullivan County Assistant District Attorney Barry Staubus, the tapes include a lengthy interview between Tucker and McDowell County detectives and a brief phone conversation between those detectives and Casey.

"A prosecutor's duty is to find all the evidence, seek the truth and that's why we went on that trip (to North Carolina) and that's why we obtained (the evidence), produced it, and turned it over," Staubus said.

Casey's attorney, Richard Spivey, hopes to use that evidence to his client's benefit. He will again ask a judge to dismiss the charges against his client. He argues Casey's due process was violated and that statute of limitations has run out. Spivey unsuccessfully made the same request in March.

"Any time as a defense lawyer, you want to review all of the evidence," Spivey said. "You want to be sure you know all pieces of evidence they have against your client and it will be very helpful in his defense, yes. Father Casey is doing very well. He's ready to defend himself."

UPDATE

Due to the discovery of new evidence the trial of former priest William Casey will be delayed.

The new evidence was found last week and a defense attorney who reviewed it said that the evidence could be helpful to the former priest.

Casey's attorney will file another request that the judge dismess the charges.

A motions hearing will be held June 10 at 1:30 p.m. The trial date is set for July 11 at 8:30 a.m.

The trial of a former priest charged with sexually abusing a child in his congregation more than three decades ago will likely be delayed this morning.

Sullivan County Deputy District Attorney Barry Staubus told 11 Connects there is a hearing set for this morning where William Casey's trial will probably be delayed.

Warren Tucker says Casey molested him more than 50 times between the ages of 10 and 15. Tucker says Casey was a priest at a church in Kingsport when the alleged abuse took place.
