Court Summary Judgement on Mater Dolorosa Protest Delayed until Next Week

HOLYOKE - A hearing for a summary judgment with the Roman Catholic Diocese and the protesters of Mater Dolorosa Church scheduled for today has been postponed until next week because the judge is on vacation.


The diocese sued the protesters, who have been holding a round-the-clock vigil in the church ever since the building officially closed in July, claiming they are trespassing. It is seeking a permanent injunction that would order the people to leave the church.

A judge rejected a plea for an emergency injunction in October, saying there seemed to be no eminent danger.

The diocese is arguing it is trying to get the protesters to leave because the steeple is structurally unsound and must be removed. Protesters said they have hired their own engineer who has found no serious problem with the structure.
