Gilmer Woman Gets 28 Years in Child Sex Abuse Case

A Gilmer woman was sentenced to 28 years in prison this past week after she pleaded guilty to child sex charges.

Upshur County’s Judge Lauren Parish of the 115th Judicial District Court sentenced Rosie Evans Fluellen, 44, to prison for criminal responsibility for the conduct of another and aggravated sexual assault of a child, according to information provided by Upshur County District Attorney Billy Byrd.

Fluellen’s husband and former Gilmer pastor Hugo Fluellen, 54, is serving six consecutive life sentences after a jury convicted him in October of several counts of indecency with a child, aggravated sexual assault of a child and sexual assault of a child.

Evidence presented during his trial showed he began inappropriately touching his victim when she was in the second grade and while he was a pastor, and that he would often molest the child on the way home from church, eventually fathering a child with her.

“She knew about it and was a party to the crime,” Byrd said of Rosie Fluellen shortly after her husband’s trial.

In 1987, Hugo Fluellen was convicted and sentenced to seven years in prison for sexual assault of a child.

Based on that previous sentence, Byrd filed an enhancement that resulted in automatic life sentences on each count in the indictment.

Hugo Fluellen will not be eligible for parole for 180 years.

Others sentenced were:

Larry Dean Donald Jr., 28, of DeBerry was sentenced to five years in prison for driving while intoxicated and five years in prison for evading arrest/detention with a vehicle. Donald pleaded guilty to the charges and the sentences are set to run concurrently.

Jason M. Williams, 34, of Hawkins was sentenced to five years deferred adjudication for possession of a controlled substance (methamphetamine). He pleaded guilty to the charge.

Derek R. Hare, 35, of Pittsburg was sentenced to eight years probation for driving while intoxicated and driving with a open container. He pleaded guilty to the charges and faces up to 10 years in prison if he violates the conditions of his probation.

Dustin Michael Apland, 34, of Ore City was sentenced to one year in state jail for unauthorized use of a motor vehicle. He pleaded guilty to the charge.

Richard Anderton III, 46, of Gilmer was sentenced to eight years in prison for driving while intoxicated. He pleaded guilty to the charge.

Horace Carl McFall, 49, of Gilmer was sentenced to eight years in prison for driving while intoxicated. He pleaded guilty to the charge.

Roderick Lynn Daniels, 25, of Gladewater was sentenced to three years in prison for delivery of a controlled substance (cocaine) in a drug free zone. He pleaded guilty to the charge.

DeMaria Newsome, 20, of Diana was sentenced to five years in prison for retaliation and five years in prison for burglary of a habitation. Newsome pleaded guilty true to the state’s allegations on both charges and the sentences are set to run concurrently.
