Attorney: 3 former Bishop McCort students will receive $50,000 each in sexual abuse settlement

Three former Bishop McCort Catholic High School students who were sexually abused by Brother Stephen Baker will receive $50,000 each in compensation, a Boston-based attorney said Tuesday.

The three, who have not been named, are in addition to 88 former Bishop McCort students named in an Oct. 21 settlement providing between $60,000 and slightly more than $120,000 each.

The Roman Catholic Diocese of Altoona-Johnstown, Province of the Immaculate Conception of the Third Order Regular Franciscans and Bishop McCort are all part of the settlement with the victims, according to information provided by attorney Mitchell Garabedian.

No additional information was provided by Bishop Mark Bartchak of the Altoona-Johnstown diocese.

“As always, the diocese does not comment on matters that involve litigation,” Tony DeGol, secretary for communications, wrote in an email.

This latest round of settlements involved men who were students at the high school between 1996 and 2000 and between the ages of 14 and 17, Garabedian said.

Those men, now ages 31 and 32, were repeatedly abused by Baker.

However, the abuse occurred outside of the state’s statute of limitations in place at that time, Garabedian said.

A fourth victim also has alleged abuse at the hands of Baker, and settlement discussions are in the works, he said.

Baker was 62 at the time of his January 2013 death, which was ruled a suicide. He abused what appears to be mostly male students while he served at Bishop McCort as a religion teacher and part of the athletic department.

He moved from Ohio in 1992 when he began working at the Johnstown high school and stayed until the early 2000s.

Garabedian would not rule out additional victims stepping forward.

“It’s been my experience that the amount of damage caused by pedophiles is ongoing ... victims continue to come forward, with no end in sight,” he said.

“This all could have been prevented.”

Judy Jones, Midwest associate director for SNAP (Survivors Network of those Abused by Priests), said these settlements are vital in helping the victims move on with their lives.

“Even though no amount of money can erase the pain inflicted upon these brave survivors, we hope they can now feel some sense of closure,” Jones said.  

Settlement talks continue between Baker victims and the Diocese of Youngstown, Ohio, and in Michigan, Garabedian said.

A timeline provided by SNAP shows that Baker worked at JFK High School from 1985 to 1992 and in Detroit at St. Mary’s Preparatory High School between 1983 and 1985.

Altoona attorney Richard Serbin, who has handled a number of Baker sexual abuse cases, said that while he was not involved in Garabedian’s cases, he did have three additional ones involving Baker independent of any other attorney.

While specifics of those settlements were not immediately available, Serbin, in an email to The Tribune-Democrat, said the settlements were reached a few weeks ago.
