Former Marine Colonel Accused Of Child Sex Abuse Gets Prison Time In Plea Deal

A highly decorated retired Marine entered an Alford plea on Tuesday morning to three assault misdemeanors in exchange for prosecutors dropping or reducing several felony charges of child sex abuse.

  • Todd Shane Tomko, 54, was sentenced to 18 months in jail, and he will get credit for the time he served. As a part of the plea deal, a judge ordered Tomko not to have any contact with the victims or their parents.
  • Prosecutors agreed to reduce three counts of aggravated sexual battery to assault and battery, and drop three charges of indecent liberties and one charge of child abuse and neglect.
  • In a preliminary hearing in March, three siblings, now two adult women and one man, described both physical and verbal mistreatment from the former Marine when he would visit Virginia Beach. They claimed he grabbed their crotches, breasts, and buttocks so hard it would often leave bruises.
  • The siblings have said the abuse spanned years, starting when the youngest was 5 years old and happened in front of their parents. They also said in the spring hearing that Tomko would expose himself and frequently made sexual comments. He often acted in a joking manner, but it was hurtful and humiliating, they have testified.

The siblings said they came forward with their allegations because they were concerned about Tomko working with children in his role as a pastor.

He had taken over a church his father had built in his hometown of Quincy, Illinois, when he was charged in November.
