A Palm Beach County family has sued Rosarian Academy and Alpha Transportation Services, alleging the school and its private bus contractor failed to properly supervise young students and protect an 8-year-old boy from repeated sexual victimization by another first-grade student during the 2024-25 school year.
According to the complaint, the alleged sexually inappropriate incidents occurred on school buses used to transport Rosarian students.
The lawsuit, filed March 27 in the 15th Judicial Circuit in Palm Beach County, says the child’s parents reported the alleged abuse to the Palm Beach County Sheriff’s Office, the Florida Department of Children and Families, and Rosarian Academy after learning what had happened.
The complaint claims the abuse went undetected for months because of inadequate supervision on the buses, including the alleged lack of a bus aide, failure to monitor surveillance footage, and a driver’s alleged cellphone use while transporting students.
The family further alleges that after notifying the school in writing on Dec. 2, 2025, and asking that the two children be kept apart, Rosarian failed to respond or put protective measures in place. The complaint says the next morning the other student was allowed to approach and confront the child at school, allegedly speaking to him about the police investigation and his disclosure to his parents.
According to the suit, the child was withdrawn permanently from Rosarian Academy on Dec. 3, 2025, and now receives trauma therapy and counseling. The parents say they lost their investment in tuition and had to reorganize their lives to homeschool him.
The complaint brings multiple claims against Alpha, including negligent supervision, negligent hiring, training and retention, and breach of contract as an alleged third-party beneficiary. It also brings claims against Rosarian Academy including negligent supervision and failure to protect, negligent retention and failure to supervise a contractor, breach of fiduciary duty, and negligent infliction of emotional distress.
The family is seeking damages in excess of $50,000 and has demanded a jury trial.
The filing does not include responses from Rosarian Academy or Alpha Transportation Services. CBS12 News has reached out to both parties for a response and will update this story when we receive their replies.
