The trial of Andrew Miller, a convicted conman and church pastor accused of raping a woman, is now in the hands of the jury following closing arguments delivered Thursday afternoon.
State prosecutors discussed the evidence presented, stating, “There was phone and computer analysis done, and there was DNA testing. Was this really a lacking investigation?” This marked a heated fourth day of testimony in the case against Miller, who faces charges of raping a woman at Albuquerque’s New Hope Church three years ago. Prosecutors allege that he posed as a producer of a reality show and sent out fraudulent messages attempting to hire models.
Miller took the stand for the second time, claiming that his interactions with the victim was consensual. However, prosecutors countered his claims. One prosecutor stated, “He was trying to cover up what had just happened and minimize the fallout. There were genital injuries consistent with the medical history.”
The defense argued that Miller did have sex with the victim, but insisted that it was consensual. The defense attorney posed the question, “Did the defendant use any physical force or violence at all? Absolutely not. There was no credible testimony that Mr. Miller used any physical force or violence against [the victims].” They also challenged the credibility of the victim, saying, “The victim herself was confused and contradictory, making statements that were inconsistent. She was caught in four different lies, claiming she didn’t remember things.”
With closing arguments now complete, Miller’s fate lies in the jury’s hands. Jurors are expected to return to the courtroom on Friday. This marks Miller’s second trial in this rape case; the first trial was declared a mistrial last August after a juror watched a news story about him.
