  Lawsuit against Deceased Priest Dismissed

DIOCESE WINS : A Lee County district judge Wednesday ruled in favor of the Davenport Catholic Diocese and the Church of All Saints of Keokuk in a sex abuse lawsuit that involved a deceased priest. The portion of the lawsuit against the Rev. Martin Diamond had been dismissed in May 2003 because he is dead. The lawsuit against the diocese and parish claimed they were negligent for not protecting the plaintiff from the priest.

MOTION : Judge John Linn upheld the diocese's motion for a summary judgment in its favor, ruling there was no evidence the church "knew about Father Diamond's alleged propensity to sexually abuse children."

ALLEGATIONS : The lawsuit was filed by a Hamilton, Ill., man who said the priest abused him from 1967 to 1970 when he was 8 to 11 years old.
