  Priest Free until Arraignment

Los Lunas [AP]–A priest accused of raping an altar boy 10 years ago is free until he appears for arraignment on the charge.

A Valencia County grand jury Thursday indicted the Rev. John Esquivel on a single count of criminal sexual penetration, Chief Deputy District Attorney Warren Harris said Friday.

Esquivel, 54 will not be arrested but must make arrangements to appear before a judge for arraignment, said police detective Charles Nuantes. He said a judge will determine at arraignment whether the priest should be jailed.

Chancellor Ron Wolf of the Archdiocese of Santa Fe said Esquibel is living with his parents in Albuquerque.

Esquibel, who served at San Clemente Parish in Los Lunas, was charged with raping a 15-year-old altar boy between March 1 and April 30, 1983.

The archdiocese suspended him last spring.
