Judge to Review Case Refuses to Halt Suit against Priest

Pittsburgh Post-Gazette (Pennsylvania)
March 30, 1994

A judge scheduled a meeting for April 12 to review issues in a Nebraska woman's allegations that a Roman Catholic priest molested her when she was a child.

U.S. District Judge D. Brooks Smith on Monday refused to dismiss a lawsuit by the Omaha woman against the Archdiocese of Philadelphia, the Altoona- Johnstown Diocese, two churches and the Rev. Joseph Strittmatter, who recently retired.

Defense attorneys said the lawsuit was invalid because 24 years have passed since the accuser could have been molested. The statute of limitations on federal lawsuits is two years.

The woman's attorney said the limit should not apply because she only recently remembered the encounters.
