  Judge Rules for Oklahoma City Archdiocese

Judge Brian Dixon, sitting as the assigned judge in the Oklahoma County District Court, recently sustained the motion for summary judgment filed by the Archdiocese of Oklahoma City.

The ruling resolves the case against the Archdiocese of Oklahoma City and The Most Reverend Eusebius J. Beltran filed by Philip Schovanec. In the case, Schovanec alleged abuse by former Alva priest Father Dave Imming.

Following the entry of judgment in favor of the Archdiocese, Schovanec gave notice of his intent to appeal. Such an appeal is likely to take from 18 to 36 months.

With the removal of the Archdiocese from the lawsuit, the plaintiff's chance of monetary award is greatly reduced.

The court ruled that Mr. Schovanec did not have sufficient evidence even to submit the matter to a jury.
