Ex-Priest Herek Loses Bid for New Trial

Omaha (AP) -- Former Roman Catholic priest Daniel Herek on Thursday lost his bid for a new trial and is headed to jail.
Herek, 61, was sentenced to 120 days in jail for lewd conduct and indecent exposure. He was convicted of exposing himself in a mall parking lot in September.
His attorney didn't know about some key evidence before Herek's original trial and so had asked for a new trial.
Prosecutor Marty Conboy said the information was not material to the conviction.
In 1999, Herek was sentenced to five years in prison and five years of probation for sexually assaulting a 14-year-old boy and making a videotape.
