EDINBURG – The judge overseeing a 1960 murder case out of Hidalgo County issued his ruling on the defense’s request for a mistrial.

Judge Luis Singleterry denied the motion for a mistrial in the John Feit murder trial. 

Feit is on trial for the murder of Irene Garza. Today marks day five of the trial.

Jurors are hearing opinions on Garza’s cause of death in the 1960 case.

Dr. Norma Jean Farley is the forensic pathologist for Hidalgo County. She wasn’t in that position when Garza’s body was discovered, but she told jurors she reviewed medical records, police reports and pictures.

Police reports state Garza’s body was found in the waters of a canal.

Dr. Farley stated her medical opinion.

“In my opinion, I don’t believe this was a drowning.”

“What, in your opinion, Dr. Farley, was Irene Garza’s cause of death?”

“In my opinion, the cause of death would be most likely an asphyxial death, meaning that here organs or tissue didn’t get enough oxygen and that resulted in her death.”

She went to say she believes the asphyxia did not have anything to with the water in the canal.

The testimony will move on to a Texas Ranger who participated in the cold case investigation.
