Retired in 2017. Placed on leave in 6/2018 after an allegation surfaced that he sexually assaulted an 8-year-old boy around 1985. Herberger strongly denied the allegation, saying he knew the boy because he would help the boy’s alcoholic and, at times, homeless, father. He said he was never alone with the boy. Returned to ministry in 12/2018 after the diocese determined the allegations were not substantiated. His accuser filed a lawsuit in 8/2019 under NY’s Child Victims Act. Herberger filed a defamation suit in 1/2020. Herberger dropped his suit in 6/2023, explaining that he could no longer afford the legal fees.
