Fr. Roy Herberger
Diocese: Diocese of Buffalo NY
Retired in 2017. Placed on leave in 6/18 after an allegation surfaced that he sexually assaulted an 8-year-old boy around 1985. Herberger strongly denied the allegation, saying he knew the boy because he would help the boy’s alcoholic and, at times, homeless, father. He said he was never alone with the boy. Returned to ministry in 12/18 after the diocese determined the allegations were not substantiated. His accuser filed a lawsuit in 8/19 under NY’s Child Victims Act. Herberger filed a defamation suit in 1/20.
Our Database of Publicly Accused does not state or imply that individuals facing allegations are guilty of a crime or liable for civil claims. The reports contained in the database are merely allegations. The U.S. legal system presumes that a person accused of or charged with a crime is innocent until proven guilty. Similarly, individuals who may be defendants in civil actions are presumed not to be liable for such claims unless a plaintiff proves otherwise. Admissions of guilt or liability are not typically a part of civil or private settlements. For more information, see our posting policy.
